Virginia – Joshua Brady, a former Sprint Nextel customer, has had his cellular phone account shut off, but not because he wasn’t paying the phone bill, or even because he was late on payments, but because a customer service representative who assisted him, began to call him outside of her job, and make death threats to him in September of 2006. She was never fired for her actions, Brady says.

Brady has agreed to be interviewed by Wikinews to tell his story. All information and claims have been logged with Brady’s attorney and federal authorities.

The representative from Sprint Nextel, who for safety reasons is only being identified as Jessica, was working at the company’s call center in Ontario, Canada where Brady’s call to customer service was directed. According to Brady, Jessica then began to call him outside of her job duties at the call center after their first contact.

Brady called the center around 6:00 p.m. (eastern time) on a Saturday and attempted to receive help on a billing question and to find a way to stop prank calls. Brady requested a “soc code”, a code placed into the phone, that would allow for the number that was pranking him to be blocked. Unfortunately, Jessica did not know what that was, but tried unsuccessfully to find it. According to Brady, the only thing she could find was “the ANI feature call centers have.”

Brady then described to Jessica the billing issue he was having. He was being charged “for text messages I was not making”, even though he had unlimited text messaging with his billing plan. Meanwhile, Jessica called for a supervisor to help locate the code. As this customer service request over the phone was taking quite a bit of time, the two of them then started to discuss what two people would normally discuss if just chatting; sports, the weather, movies and music and if Virginia was a nice place to go on vacation. The supervisor then came by Jessica’s station with no luck on finding a code.

Later that night, around 10:30 p.m., Brady received a call. He answered it and much to his surprise, it was Jessica. He answered the phone with the usual “hello” and the voice on the other end answered with “hello Josh.” Brady was “surprised” that she had not said “hello Mr. Brady.”

“I then asked who it was, and she said Jessica. She told me about her day, and hoped that I did not mind her calling.” Then according to Brady, she started to describe how much she hated working in a call center, and how the job “pays the bills”, and asked if she could “come visit me sometime”. Brady said that he “immediately started to record” the call. Brady also stated that Jessica was not aware she was being recorded, and that further conversations were recorded without her knowing.

The call lasted about 15 minutes, but Brady said she “spoke so fast and moved along through things” that he “didn’t have a chance to talk if I wanted to. It [the call] ended with me interrupting her and telling her I had to go to dinner with a friend.”

Brady immediately called customer care back and reported Jessica’s actions to a supervisor (Jason), and the Floor Manager (Also named Jessica) at the Coos Bay call center, which is where his call happened to be directed. The advice he received was to “play along” and continue to report her actions until they could locate someone “better equipped” to handle the situation.

Jessica then began to call “about every other day or so” which turned out to be almost 30 calls, according to Brady who reported each call she made to Sprint Nextel.

Sprint Nextel then told Jessica to cease and desist all contact with Brady, but that didn’t stop Jessica from contacting him. She somehow found out the screen-name of his AOL Instant Messenger account, and left messages threatening to kill him. Brady logged the messages and faxed them to Sprint, who about a week later sent Brady a letter, saying that his accounts have been terminated.

“The purpose of this letter is to inform our that our office has received a complaint regarding your recent questionable interactions with our customer care group. Recent interactions with our company have prompted us to formally contact you. Sprint Nextel terms and conditions state that “termination of services. consistent with this agreement…”, said the letter from Sprint Nextel.

Brady states that Jessica is still employed with Sprint Nextel, despite the fact that all instant messages left by Jessica were forwarded to Sprint Nextel.

As recently as July 10, 2007, as many as 1,000 accounts were terminated by Sprint Nextel because customers were complaining too much and asking too many questions about billing.

“While we have worked to resolve your issues and questions to the best of our ability, the number of inquiries you have made to us during this time had led us to determine that we are unable to meet your current wireless needs,” said one letter to a sprint customer as recent as June 29, 2007. The letter states that the service will be terminated just one day after the letter was written despite saying they “understand switching to a new carrier causes an inconvenience.”

Two weeks ago, Sprint addressed the media about the mass-cancellations. “These accounts have been researched very carefully,” Sprint spokeswoman Roni Singleton said. “We feel strongly that the decisions we made, we stand by them. These decisions weren’t made lightly.”

“If the average person is calling less than once per month and these people are calling 40 or 50 times more, that takes away from customer service,” Singleton said. “Our priority is to improve the customer experience.”

Wikinews sent e-mails to Sprint Nextel on July 20 regarding the Brady incident; to date no response has been received.

Update: On July 23, 2007, Wikinews received an email response from a Sprint representative, going to some length to explain the termination of the customers who were calling up to hundreds of times a month. No information was given on the Brady case covered in this article; “customer privacy considerations” were cited as the reason and “no comment” was Sprint’s reply.

Today, the English version of Wikipedia is taking part in a 24-hour ‘blackout’ to protest two proposed U.S. anti-piracy laws, the Stop Online Piracy Act and the PROTECT IP Act. The protest mirrors similar actions from other websites including Reddit and Boing Boing. The White House stated on Saturday that they “will not support legislation that reduces freedom of expression, increases cybersecurity risk, or undermines the dynamic, innovative global internet”.

In the midst of the Wikipedia blackout, executive director of the Wikimedia Foundation Sue Gardner answered some questions posed by Wikinews’ Tom Morris about the effectiveness of, and background to, the blackout.

((Tom Morris)) Do you think the blackout is going to actually be effective?

((Sue Gardner)) Yes. In my opinion, the blackout has two main goals—to raise awareness about the dangers of SOPA and PIPA, and to encourage readers to contact their elected representatives and give their views. The first has already been accomplished: there are already more than 4,000 stories in Google News about the blackout, and it was a trending topic on Twitter almost immediately. So we know we’ve been effective in raising awareness. What remains to be seen how many people will contact their elected officials.

((TM)) What do you say to people who have decided to leave the editing community as a result of the blackout?

((Gardner)) I hope nobody stops editing Wikipedia because of the blackout. I watched the community decision-making process unfold on the English Wikipedia, and I thought it was a good one. People first started talking about SOPA more than a month ago. Jimmy started the straw poll in mid-December. Over 1,800 English Wikipedians from many different countries participated in the discussion over the last three days. As the admins who closed it noted, this is by far the largest-ever number of participants in a community discussion on English Wikipedia, and the overwhelming majority of them supported action. So I would hope that anybody who opposes the blackout would also agree that the decision-making process was a good one, and would therefore be okay to accept it, however reluctantly.

((TM)) How much technical planning went into the blackout before the community consensus was decided on Monday night?

((Gardner)) Last Thursday Geoff Brigham [Ed: Wikimedia’s legal counsel] asked engineering to do an internal assessment of the technical implementation requirements, because the community discussions at that point were suggesting there would likely be some kind of action. Engineering did an initial assessment based on e.g. the Italian blackout, implications for search engines, etc., and then a lot of work happened over the weekend. The bulk of initial development and testing happened on a sprint on Martin Luther King Day, a public holiday in the United States, and the final launch development and testing sprint happened on Tuesday.

((TM)) Does the fact that this is affecting only English Wikipedia and not the sister projects and other language projects concern the Foundation?

((Gardner)) No. My understanding is that the English Wikipedia is the only project and language-version enacting a blackout, but that several other projects and language versions are putting up supportive banners, with the Italian Wkipedians doing a clickthrough informational interstitial. The German Wikipedia decided to put up banners even before consensus was reached on the English Wikipedia, and the Arabic Wikipedia, Italian Wikipedia and Commons later made the same decision. (There may be others, that I don’t know about.) I think that’s fine: each project and each language has different circumstances that argue for different types of action, or for no action. There is no one right answer that fits everybody.

((TM)) Some have said that the lack of participation by opponents of SOPA in the commercial sector (sites of the size of Twitter, Facebook, Google etc.) is going to hamper the effectiveness of the blackout – is this a concern?

((Gardner)) No. I don’t think anybody ever expected the big commercial sites to black out: most aren’t in a position to participate in something like this even if they wanted to. For example, they might have shareholders to answer to, participation might cost them significant revenue, or it could break contractual agreements (such as a commitment to maintain a certain level of uptime, or some other service delivery). Most sites are constrained by various commercial considerations: that makes Wikipedia’s participation particularly powerful and important.

((TM)) Given both the Italian shutdown and the SOPA blackout, is the Foundation going to come up with a policy or set of conditions which limit when these kind of things happen? There are plenty in the community who support the SOPA actions but are concerned that this will set a bad precedent.

((Gardner)) Yeah, I empathize with those people and to a certain extent I share that concern. The Wikimedia movement does not have a lot of experience with advocacy, and probably mistakes will get made. At this time the Wikimedia Foundation doesn’t have any plans to develop policy governing protests or advocacy work. But, I think it probably does make sense for the Foundation to create venues for these discussions so people can share thinking and expertise. So for example, we may create a mailing list dedicated to advocacy/lobbying. And there is some good thinking starting to happen [on the project-wide protests page on Meta].

Yesterday, German football club FC Bayern Munich announced signing of Corentin Tolisso from Olympique Lyonnais. The 22-year-old French international midfielder has signed a five-year contract.

Tolisso joined Lyon’s academy when he was 13-years-old and made 160 appearance for the club in all competitions scoring 29 goals.

Via their official website, Lyon announced that the clubs agreed to a fee of €41.5 million (£35 million) for Tolisso’s transfer. Per the agreement, Lyon may receive a bonus up to €6 million depending on the Tolisso’s performance. This was the highest transfer money Lyon has received till now, the French club said.

Lyon club president Jean-Michel Aulas said Tolisso’s departure was an “emotional and qualitative loss” ((fr))French language: ?une perte affective et qualitative for the club and described him as “an exceptional player, undoubtedly one of the best European in his position but also a man with a strong personality.” ((fr))French language: ?un joueur exceptionnel, sans doute un des meilleurs européens à son poste mais aussi un homme à forte personnalité. Previously, Bayern had announced signing Serge Gnabry, Sebastien Rudy and Niklas Süle.

A series of large explosions have occurred close to Hemel Hempstead Hertfordshire, UK. The source of the explosions has been confirmed as the Hertfordshire Oil Storage Terminal (HOSL), Hemel Hempstead, known locally as the Buncefield complex. Up to 150 fire fighters are reported to be at the scene with 10 fire appliances and 1 specialist foamer.

The first ‘blast’ was heard near Hemel Hempstead on Sunday 11 Dec at 6 am. Further smaller explosions followed at 6:24am , 6:26am, 6:30am. BBC News 24 reported an additional, fourth large explosion. Hertfordshire Police Constabulary are currently treating the explosion as an accident.

Reports say the explosion, which registered 2.4 on the Richter scale, was heard as far away as Oxford, and Whitehall, Central London which is 60km (38 miles) away. Eyewitness statements report that the explosion was heard from at least 160km (100 miles) away and as far away as France and The Netherlands. Pilots reported noticing the blast from the North Sea and the West Country area of the UK. The M1 motorway which runs close by has been closed in both directions near the blast which is causing travel chaos as other roads become congested.

Malcom Stewart, a BBC News24 eyewitness who is a tanker driver for the site has reported that the site supplies several oil companies and is a joint operation between Total UK and Texaco, it is also used by BP, Shell and the British Pipeline association. The complex is not a refinery but a storage facility for refined petroleum awaiting distribution to airports and filling stations. The eyewitness reports that the depot has approximately 20 tanks which can hold about 3 million gallons (11 million litres or 70,000 barrels) each. Another News24 eyewitness has just reported that he has seen at least 5 of these tanks on fire.

The depot operates on a 24 hour basis and is split into 2 parts – aviation fuel and domestic fuel. A number of eyewitnesses have reported on UK news that the aviation fuel side appears to be the part of the site that has been affected.

Local authorities were not immediately available for comment but there have been reports of casualties.

Some reports on live television state that, “Several other neighbours said they did see a plane go into the depot.” BBC News 24 were also discussing the idea a possible plane crash as the cause of the explosions. Hertfordshire police have now gone on the record to say that there is no plane involved (BBC News24).

The police have issued a contact number 0800 096 0095 and asked that people do not call the emergency services in Hertfordshire directly unless it is an emergency.

In addition to being an oil storage depot, it is a major hub on the UK oil pipeline network with pipelines to Killingholme Lindsey Oil Refinery (LOR), Humberside (10 inch), Merseyside (10 and 12 inch), Coryton on the Thames Estuary (14 inch) and Heathrow (6 and 8 inch) and Gatwick airports radiating from it.

The disaster is believed to be the worst explosion at a petrochemical plant in the UK since the Flixborough disaster of 1974.Hertfordshire’s Chief Fire Officer Roy Wilsher said: “This is possibly the largest incident of its kind in peacetime Europe.”

A firefighting press officer said that they are stock piling foam from neighboring regions for a prolonged attach which they hope will stop the spread of the fire, however, the inferno itself will have to burn out which could take between 24 hours and a few days.

Despite the authorities saying that there is no need to panic buy petrol, filling stations have had above average queues since this morning and some small garages have ran out.

Deputy Prime Minister John Prescott has visited the scene.

Wide, flat, and flexible, Crocs clogs have become increasingly popular in recent years, with the company selling 6 million of them in 2005, reported Good Morning America. However, some of the characteristics that may contribute to the shoes comfort also make them dangerous in certain situations. Their soft, flexible material provide wearers with little protection from heavy falling objects, as well as from the edges of escalators, which have caused numerous injuries in recent years. With cases of children injured in Orange County, California and elsewhere, a well as several lawsuits against the company, safety advocates and attorneys are questioning whether Crocs adequately warned parents about the dangers of wearing the shoes while riding escalators.

The United States Consumer Product Safety Commission (CPSC) formally recognized the risks associated with escalators in a 2008 consumer advisory. At that time, the agency stated that in 2007 accidents on escalators resulted in 11,000 injuries, 10 percent of which involved the entrapment of hands, feet, or shoes. According to the CPSC, the foot was the most common area injured, and [soft-sided] shoes are the most likely to get stuck and pose the possibility of injury to the rider. Of the 77 entrapment accidents that resulted in injury between January 2006 and May 2008, only two did not involve soft-sided flexible clogs and slides. In Orange County, California, a 4-year-old girl recently suffered serious injury while wearing Crocs on an escalator, explains an attorney. The accident occurred in August 2011 while the girl was riding an escalator in the Westminster Mall and her shoe became caught in the side of the machine. She lost her toe and some of the skin on one of her feet. In January 2012, the girls parents brought a lawsuit against Crocs, alleging that the warning tags accompanying the shoes were easily overlooked, reported the Orange County Register. If the parents opt to sue the company under the legal theory of liability for failure to warn, they will have to prove that the shoes are inherently dangerous when worn in a certain waysuch as on an elevatorand that the company failed to sufficiently warn consumers of this risk. The success of this argument may depend on how visible the warning label was and how effectively it conveyed the risk of injury or harm to the parents. According to the lawyer representing the parents, the warning label was one of three tags that came with the shoes, so the parents may not have noticed it. One possible defense the company may use is that no actual defect exists and that the product performed as it was supposed to and/or that the injuries did not arise in the normal course of use. Crocs are flexible shoes and they are non-stick shoes. It is natural that any rubber shoe would not provide as much protection from an escalator and any non-skid shoe would make it more difficult to quickly move the feet. As such, when a child wears Crocs (or a parent dresses a child in Crocs) and places his or her foot near the edge of an escalator, this is not an intended use of the product, especially since a label expressly says not to place the foot near the edge of an escalator. If a plaintiff defies manufacturers instructions to refrain from doing something, the plaintiff cannot then hold the company liable for injury that occurs when doing the forbidden task, unless the plaintiff wasn’t adequately warned. While the outcome of this case will likely determine whether or not Crocs failed to adequately warn consumers about the risks associated with wearing the shoes on escalators, the best course of action may be to heed the CPSCs advisory not to wear any soft, flexible shoes or sandals on the machines.

Australia’s High Court, in a unanimous decision today, found modchips to be legal. Mod-chips are attached to the system’s motherboard to allow users to bypass copy detection and regional controls on game consoles such as PlayStation 2 and Xbox.

While playing illegally copied games is a primary reason for some people to install modchips, modchips are still considered legal. They allow users to play games imported from different regions, play homebrew games, and create archival copies of games. Imported games are often cheaper and available sooner than from countries with late official release dates, such as Australia. The court recognised that by the time a mod chip acts upon a copied game, the copyright violation has already taken place — the mod chip is not responsible for the copyright violation.

In many other countries selling and using modchips is illegal. In the UK the EU Copyright Directive has been used by Microsoft and Sony to prevent sales of modchips. The EU Copyright Directive makes it illegal to circumvent copy protection systems. A similar law, the Digital Millennium Copyright Act (DMCA), makes it illegal in the USA.

The defendant in the case was retailer Eddy Stevens, who sold and installed PlayStation 2 modchips. Sony, the manufacturer of the Playstation 2, sued, arguing that modchips were in violation of Australian copyright law.

The court ruled that because the modchips merely allow users to play copied or imported games, and do not enable the copying of games, modchips do not breach copyright. “There is no copyright reason why the purchaser should not be entitled to copy the CD-ROM and modify the console in such a way as to enjoy his or her lawfully acquired property without inhibition,” said the court. “This is a hell of a victory for the consumer. That’s why we did it,” said Mr. Stevens.

The court also ruled that reading a program into RAM, while the game is being played, does not count as making a copy under copyright law.

The Australian case is unique in that it is considered to be the first time DMCA-like provisions have been considered by a court of final appeal anywhere in the world.

Opinions rooted in racism, sexism, homophobia are commonly unacceptable to express in public or in polite company. Michael Richards shouted down a black heckler by yelling, “Shut up!” followed by “He’s a nigger!” and gave his already dormant career less of a chance of ever reviving. When Isiah Washington called a co-star on Grey’s Anatomy a “fag,” his contract was not renewed.

None of this would have happened to either actor if instead of racist or homophobic terminology they had said, “Shut up, fattie!” or “Fat ass!” It’s not an easy time to be fat in America. A fat person is seen as weak-willed, as suffering from an addiction to food, as unhealthy and deserving of ridicule. It goes without saying that people who are overweight are, indeed, people with a full range of emotions and feelings that are as easily hurt as a thin person’s.

A Louisiana representative has proposed a controversial solution to “generational welfare,” which would pay women on welfare to get sterilization. Republican John LaBruzzo said he thought of the idea because of his constituents’ outrage over paying for welfare.

“You have these people who are just fed up with working their buns off to try to provide for their own family and being forced by the government [to] provide for others’ families who just want to have unlimited kids”, he commented. He is currently working with Baton Rouge to gather data in support of his proposal.

LaBruzzo, who is pro-life, said that the people “on the other side of the political spectrum are pro-choice. Well, let’s give these people the ability to choose.”

While LaBruzzo has stated that he has received an outpouring of support over his idea, the ACLU spoke out against the proposal and called it a “meanspirited attempt to eliminate the poor.” Planned Parenthood representative Julie Mickelberry called it a “bribery”, suggesting a solution which attacked the root of the problem was needed and that the representative needed to “go back to addressing issues of education about unintended pregnancy and opening healthcare access.”
