HIV-positive man receives 35 years for spitting on Dallas police officer

Sunday, May 18, 2008

An HIV-positive man was sentenced to 35 years in prison Wednesday, one day after being convicted of harassment of a public servant for spitting into the eye and open mouth of a Dallas, Texas police officer in May 2006. The United States Centers for Disease Control and Prevention says that no one has ever contracted HIV from saliva, and a gay-rights and AIDS advocacy group called the sentence excessive.

A Dallas County jury concluded that Willie Campbell’s act of spitting on policeman Dan Waller in 2006 constituted the use of his saliva as a deadly weapon. The incident occurred while Campbell, 42, was resisting arrest while being taken into custody for public intoxication.

“He turns and spits. He hits me in the eye and mouth. Then he told me he has AIDS. I immediately began looking for something to flush my eyes with,” said Waller to The Dallas Morning News.

Officer Waller responded after a bystander reported seeing an unconscious male lying outside a building. Dallas County prosecutors stated that Campbell attempted to fight paramedics and kicked the police officer who arrested him for public intoxication.

It’s been 25 years since the virus was identified, but there are still lots of fears.

Prosecutors said that Campbell yelled that he was innocent during the trial, and claimed a police officer was lying. Campbell’s lawyer Russell Heinrichs said that because he had a history of convictions including similarly attacking two other police officers, biting inmates, and other offenses, he was indicted under a habitual offender statute. The statute increased his minimum sentence to 25 years in prison. Because the jury ruled that Campbell’s saliva was used as a deadly weapon, he will not be eligible for parole until completing at least half his sentence.

If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.

The organization Lambda Legal (Lambda Legal Defense and Education Fund), which advocates for individuals living with HIV, says that saliva should not be considered a deadly weapon. Bebe Anderson, the HIV projects director at Lambda Legal, spoke with The Dallas Morning News about the sentence. “It’s been 25 years since the virus was identified, but there are still lots of fears,” said Anderson.

The Dallas County prosecutor who handled the trial, Jenni Morse, said that the deadly weapon finding was justified. “No matter how minuscule, there is some risk. That means there is the possibility of causing serious bodily injury or death,” said Morse. Dallas County District Attorney Craig Watkins stated: “If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.”

Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.

A page at the CDC’s website, HIV and Its Transmission, states: “HIV has been found in saliva and tears in very low quantities from some AIDS patients.” The subsection “Saliva, Tears, and Sweat” concludes that: “Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.” On Friday the Dallas County Health Department released a statement explaining that HIV is most commonly spread through sexual contact, sharing needles, or transfusion from an infected blood product.

Arizona nurse arrested for impregnating critically disabled woman

Wednesday, January 23, 2019

Phoenix, Arizona, police announced the arrest of Nathan Sutherland, 36, on Wednesday. He was taken into custody on suspicion of raping a patient at the Phoenix Hacienda Healthcare facility where he worked as a licensed practical nurse. The woman, whose impairments prevent her from consenting to sex, gave birth to a healthy baby boy this past December.

According to Phoenix Police Chief Jeri Williams, Sutherland is currently facing two felony charges, one count each of sexual assault and abuse of a vulnerable adult.

“The charges in this case are very serious. The defendant sexually assaulted a very vulnerable adult who had no capacity to resist, no capacity to cry out,” said one prosecutor at Sutherland’s initial court appearance.

Neither the staff at the Hacienda Healthcare facility nor the woman’s family knew she was pregnant until the day she gave birth. Court documents list the woman, 29, as “unable to make any decisions or give consent due to her disability.” She had been in the care of this Hacienda Healthcare facility since age 3. Her parents told the press she has limited movement in her arms, legs, neck, and face but does have “significant intellectual disabilities as a result of seizures very early in her childhood.”

As part of the investigation, authorities tested the DNA of all the facility’s male employees. According to police spokesperson Tommy Thompson, Sutherland was given a court order to submit to a DNA test last Thursday. He complied, and the results indicated he is the child’s biological father.

Sutherland otherwise declined to speak to the police, invoking his right not to do so under the fifth amendment of the United States constitution.

“There’s no direct evidence that Mr. Sutherland has committed these acts,” said Sutherland’s lawyer, David Gregan. “I know at this point there’s DNA. But he will have a right to his own DNA expert.” Both Gregan and a former neighbor of Sutherland’s described him as a good father to his children.

The woman is a member of the San Carlos Apache tribe.

Hacienda Healthcare issued a public apology and suspended one doctor who worked at the facility. Another resigned. William Timmons, their CEO at the time, also resigned.

Sutherland’s bail hearing was today. A Maricopa County Superior Court commissioner set bail of US$500,000 cash and ordered he wear a monitoring bracelet if released. His next court appearance is scheduled for January 30.

Spanish town council electee proposes nudist pool, marijuana field in park

Friday, June 1, 2007

A former mailman who proposed to paint the town hall pink, turn the local town square into a nudist pool, and to plant a marijuana field in the local park has been elected to the Reus, Spain town council.

Ariel Santamaria promised to show up to the town’s council meetings dressed up as Elvis Presley if he was elected and kept his word at the town’s first meeting on Thursday.

Before being elected, Santamaria who is a member of the Reus Independent Coordination, had also promised the town’s 100,000 residents that he would install a GPS system at the police department that would allow officers to track people who are smoking marijuana and provide them with a light if they need one.

An unnamed media consultant who works for Santamaria set up a website for his campaign and followed Santamaria wherever he went, dressed as a pirate.

BBC to cut Electric Proms for financial reasons

The BBC have announced they are to axe annual music festival Electric Proms from their schedule for financial reasons. The festival first took place in October 2006. The 2011 event will not go ahead, with last year’s festival being the last.

Bob Shennan, controller of BBC Radio 2, said he was “disappointed” with the decision to cancel the festival. He said “In the current climate, we are faced with making difficult decisions, including how best to deliver high-quality live music programming throughout the year in light of continuing efficiency savings. I feel that Radio 2 can achieve the same impact of the Electric Proms in an alternative, more cost-effective way. I’m disappointed that the lifetime of Electric Proms has come to an end, but very proud of its fantastically rewarding run of creating new moments in music for the past five years.”

During the festival’s five year run it has featured performances from stars such as Elton John, Neil Diamond, and Shirley Bassey.

The decision to axe the festival comes at a time when the BBC are planning a 20% savings cut. Last week BBC director general Mark Thompson announced 650 job losses after dropping five languages from the BBC World Service.

How To Make Your Ex Boyfriend Miss You So Much It Hurts Him To Think Of You!

By H.L. Archer

When you are involved in a breakup, it is easy to become consumed with your own feelings of confusion and despair. You forget your ex may be feeling the same way. You are wondering how you can get your ex back and that will cause you to harass your ex boyfriend by constantly being in his face. If you want your ex boyfriend back, you will have to give him a chance to miss you. He cannot possibly miss you as long as you are always around. This means that you should make yourself scarce.

Take a vacation or visit out of town relative and friends. This will help you get your emotions under control and give him time to sort things out. When they are angry, men need time alone to sulk and feel sorry for themselves. By interrupting this time you only make it last longer. So stay away from your ex and have no contact with him at all for a while. Doing this will give him the chance to experience what his life is like without you and he will find that he does not like it.

[youtube]http://www.youtube.com/watch?v=pzDkY1zN510[/youtube]

During this time you might think of getting back with your family again. They will welcome you with open arms and their love and support will help rebuild your confidence. Take up a hobby or some night classes. Do things you always wanted to do. The main thing is to think of what will make you happy and keep your mind off your ex. Go out with your girlfriends and have fun. Your ex boyfriend will be aware of these activities and will wonder if you still care for him. He will remember the good times you had together and want them back.

When he begins to yearn for you again, he will miss you so much it will hurt to think of you. He will begin regretting his decision of breaking up with you. All of these things will make him be the first to make contact. This is what you want. Instead of you chasing him, you want him to chase you again, as he did at the start. His first attempt to contact you will be by email. He will just ask how you are doing and leave it at that. This is his way of seeing where he stands with you. If you do not answer him, he will be concerned that you might have another guy.

This will force to call and ask you to meet hi for a talk. Of course, you will want to jump at the chance to be with him again, but do not appear anxious. It will be hard to do, but tell him you have a lot going right now and you will have to get back to him. This shows him that he is no longer your top priority and he will have to take his turn. Do not discourage him by making him wait too long. Call him back in a few days to arrange a place and time.

Australia to lose $2 billion due to Japanese disasters

Australia to lose $2 billion due to Japanese disasters

Friday, April 1, 2011

The fallout from earthquake and tsunami catastrophes in Japan will cost Australia about A$2 billion in lost export earnings in the near term due to lower Australian exports to Japan, according to estimates in a Treasury brief released Thursday. After China, Japan is Australia’s largest export market, making up 15 percent of its total exports.

The tragic events in Japan—together with the impact of floods and Cyclone Yasi at home—will clearly mean revenues take a substantial hit in the near term.

“The tragic events in Japan—together with the impact of floods and Cyclone Yasi at home—will clearly mean revenues take a substantial hit in the near term”, Treasurer Wayne Swan said in the brief.

Short term exports of “non-rural bulk commodities” are predicted to be lower as Japanese port facilities, coal-fired power stations and steel-making plants were damaged. Businesses whose export products are designated for Japan must find other customers to replace Japanese clients, the brief said. The loss of Japanese markets has been a contributor to a 6 percent drop in the price of iron ore and an 8 percent drop in the price of coal. Japan imports account for 27 percent of Australia’s iron ore and coal exports.

Also on Thursday, Japan’s manufacturing production index experienced its sharpest fall in the decade since data has been collected, indicating a steep fall in output for most businesses in Japan in March. Recently, Japanese industry seemed to be rebounding from the global financial crisis.

In Asia, concern is mounting that the electricity shortages and other disruptions to Japan’s manufacturing sector will affect manufacturing in various areas of Asia, since the manufacturing of many goods are dependent on the integrated network of supply chains.

Hurricane Nate weakens as it reaches United States

Hurricane Nate weakens as it reaches United States
By | Posted in Uncategorized

Monday, October 9, 2017

After killing 30 people on a rampage through Honduras, Costa Rica, El Salvador, and Nicaragua and dumping rain on the Yucatan in Mexico, Hurricane Nate reached the U.S. states of Louisiana and Mississippi on the north shore of the Gulf of Mexico on Saturday night. The National Hurricane Center (NHC) downgraded Nate to a tropical storm on Sunday morning. A state of emergency was declared parts of Louisiana, which saw damage from the significantly more intense Hurricane Harvey earlier this year; Alabama; Florida; and Mississippi.

Nate made its first U.S. landfall on Saturday night, bringing winds of 85 miles per hour (134 kph) and considerable storm surge to the mouth of the Mississippi River. By Sunday morning, these had declined to 35 miles per hour (56 kph). Tens of thousands of households in Mississippi, Alabama, and Louisiana were without power.

In contrast, when Nate made its way across Latin America, dozens of people died. Some 400,000 Costa Ricans lost access to safe drinking water. All train travel and a great deal of air travel halted, and many national parks closed. Landslides trapped travelers in a dangerous road segment nicknamed “the Mountain of Death” on the Inter-American Highway, and the high water of the Tárcoles River raised concerns about crocodile attacks.

“We were well aware that this could’ve been a much more serious storm. There was talk of it being a Category 2 with an 11-feet tidal surge when it came ashore. It did not — happily — it did not live up to that billing,” said Vincent Creel, public affairs manager for Biloxi, Mississippi, near which Nate made its second U.S. landfall.

The storm had been expected to move further west, and some evacuations were recommended in the New Orleans area in preparation. Many of the ports on the U.S. Gulf Coast were closed to shipping. In one way, Nate is having a more pronounced effect than Harvey: production of oil and natural gas is a fraction of normal levels as workers evacuated oil rigs and platforms.

The NHC forecast the storm to continue north and east, losing intensity as it moves inland.

“Our great team at FEMA [Federal Emergency Management Agency] is prepared for #HurricaneNate. Everyone in LA [Lousiana], MS [Mississippi], AL [Alabama] and FL [Florida] please listen to your local authorities and be safe!” tweeted President Donald Trump.

This is the fourth major hurricane to hit U.S. territory since summer, after Harvey, Irma, and Maria.
